Qualifying for Disability Benefits Through Parent Work Record
Social Security Disability Insurance (SSDI) is a federal program primarily designed to aid people who have become disabled after having worked for a certain amount of time. Although the typical SSDI recipient has worked for a fairly long time before the onset of their disability, an adult who became disabled before turning 22 can also qualify for SSDI if they have a parent who meets certain qualifications.

An SSDI benefit depends on the beneficiary’s income before they became disabled, the size of their family, and the amount they have paid into the Social Security system. A beneficiary typically must have paid into the Social Security system for at least 10 years prior to their disability. Most people who have a serious disability before turning 22, however, are not able to assemble the necessary work record to qualify for SSDI on their own.

In certain situations, they may instead be able to qualify for SSDI on their parents’ work record. This is possible under the Social Security Administration’s (SSA) Disabled Adult Child (DAC) program.

Disabled Adult Child Program

To qualify for the DAC program, the following conditions must be met: The adult child who is disabled must have a qualifying disability that meets the SSA’s strict adult disability standards.
This person must be age 18 or older, and may be an adopted child, or, in some cases, a stepchild, grandchild, or stepgrandchild. They also must be legally single, not married.
Their disability must have occurred before they turned 22.
The potential beneficiary’s parent must have paid into the Social Security system long enough to have become fully insured for retirement benefits.
Finally, the potential beneficiary’s parent must be either deceased, permanently disabled, or currently receiving Social Security retirement benefits.

If an adult disabled child and their parent meet all of these qualifications, then the adult child should be able to receive a substantial benefit, often greater than a Supplemental Security Income (SSI) award. On top of the monetary gain, the disabled adult child does not have to worry about their own unearned income or assets, since SSDI does not take these into account.

However, if the adult child with the disability earns income through employment, the SSA may determine that they are no longer disabled and cancel their SSDI benefits. Earnings must be no more than $1,350 per month ($2,260 if the disability is blindness).

The parent’s own retirement benefits are not affected by their child’s receipt of SSDI. In addition, the disabled adult child can still qualify for SSI benefits if their SSDI payments, which count as unearned income for SSI purposes, do not disqualify them.

Plan Ahead for Your Child

Parents of a child with disabilities who think that their child may one day qualify for SSDI might consider having their child screened by the Social Security system for their disability well their child reaches age 22, and well before the parents themselves start receiving their own Social Security benefits.

In any event, it is a good idea to have the child’s physician keep detailed records of the child’s disability from as early an age as possible. This way, when the parents retire and start receiving Social Security, the child will have a thorough documentation of the disabling condition up to age 22, making the SSDI application easier.

What do I need to know about Advance Designation?

You should be aware of another type of representation called Advance Designation.

Advance Designation allows capable adult and emancipated minors who are applying for or receiving Social Security benefits, Supplemental Security Income, or Special Veterans Benefits the option to choose up to three people in advance who could serve as their representative payee, if the need arises.

In the event that you can no longer manage your benefits, you and your family will have peace of mind knowing that someone you trust may be appointed to manage your benefits for you. If you need a representative payee to assist with the management of your benefits, we will first consider your advance designees. We must still fully evaluate them and determine their suitability at that time.

You can submit and update your advance designation request when you apply for benefits or after you are already receiving benefits. You may do so through your personal my Social Security account, contacting us by telephone at 1-800-772-1213 (TTY 1-800-325-0778), or at your local office.

What We Mean by Disability

The definition of disability under Social Security is different than other programs. We pay only for total disability. No benefits are payable for partial disability or for short-term disability.

We consider you to have a qualifying disability under our rules if all the following are true:

  • You cannot do work and engage in substantial gainful activity (SGA) because of your medical condition.
  • You cannot do work you did previously or adjust to other work because of your medical condition.
  • Your condition has lasted or is expected to last for at least 1 year or to result in death.

This is a strict definition of disability. Social Security program rules assume that working families have access to other resources to provide support during periods of short-term disabilities, including workers' compensation, insurance, savings, and investments.

2. Is your condition "severe"?

Your condition must significantly limit your ability to do basic work-related activities, such as lifting, standing, walking, sitting, or remembering – for at least 12 months. If it does not, we will find that you do not have a qualifying disability.

If your condition does interfere with basic work-related activities, we go to Step 3.

3. Is your condition found in the list of disabling conditions?

For each of the major body systems, we maintain a list of medical conditions we consider severe enough to prevent a person from doing SGA. If your condition is not on the list, we must decide if it is as severe as a medical condition that is on the list. If it is, we will find that you have a qualifying disability. If it is not, we then go to Step 4.

We have 2 initiatives designed to expedite our processing of new disability claims:

  • Compassionate Allowances: Certain cases that usually qualify for disability can be allowed as soon as the diagnosis is confirmed. Examples include acute leukemia, Lou Gehrig’s disease (ALS), and pancreatic cancer.
  • Quick Disability Determinations: We use computer screening to identify cases with a high probability of allowance.

4. Can you do the work you did previously?

At this step, we decide if your medical impairment(s) prevents you from performing any of your past work. If it doesn’t, we’ll decide you don’t have a qualifying disability. If it does, we proceed to Step 5.

5. Can you do any other type of work?

If you can’t do the work you did in the past, we look to see if there is other work you could do despite your medical impairment(s).

We consider your medical conditions, age, education, past work experience, and any transferable skills you may have. If you can’t do other work, we’ll decide you qualify for disability benefits. If you can do other work, we’ll decide that you don’t have a qualifying disability and your claim will be denied.

Special Situations

Most people who receive disability benefits are workers who qualify on their own records and meet the work and disability requirements we have just described. However, there are some situations you may not know about:

Special Rules for People Who Are Blind or Have Low Vision

We consider you to be legally blind under our rules if your vision cannot be corrected to better than 20/200 in your better eye. We will also consider you legally blind if your visual field is 20 degrees or less, even with a corrective lens. Many people who meet the legal definition of blindness still have some sight and may be able to read large print and get around without a cane or a guide dog.

If you do not meet the legal definition of blindness, you may still qualify for disability benefits. This may be the case if your vision problems alone or combined with other health problems prevent you from working.

There are several special rules for people who are blind that recognize the severe impact of blindness on a person's ability to work. For example, the monthly earnings limit for people who are blind is generally higher than the limit that applies to non-blind workers with disabilities.

In 2023, the monthly earnings limit is $2,460.

Benefits for Surviving Spouses with Disabilities

When a worker dies, their surviving spouse or surviving divorced spouse may be eligible for benefits if they:

  • Are between ages 50 and 60.
  • Have a medical condition that meets our definition of disability for adults and the disability started before or within seven years of the worker's death.
Surviving Spouses or surviving divorced spouses who were receiving benefits for caring for the worker's child(ren) may be eligible for disabled surviving spouse’s benefits. They qualify if they have a disability that begins before those payments end or within 7 years after they end.

Surviving spouses and surviving divorced spouses cannot apply online for survivors benefits. If they want to apply for these benefits, they should contact Social Security immediately at 1-800-772-1213 (TTY 1-800-325-0778) to request an appointment.

To speed up the application process, they should complete an Adult Disability Report and have it available at the time of their appointment.

For these benefits, we use the same definition of disability as we do for workers.

Benefits for Children with Disabilities

A child under age 18 may have a disability, but we don't need to consider the child's disability when deciding if he or she qualifies for benefits as a dependent. The child's benefits normally stop at age 18 unless they are a full-time elementary or high school student until age 19 or have a qualifying disability.

Children who were receiving benefits as a minor child on a parent’s Social Security record may be eligible to continue receiving benefits on that parent’s record upon reaching age 18 if they have a qualifying disability.

Adults with a Disability that Began Before Age 22

The Disabled Adult Child (DAC) — who may be an adopted child, or, in some cases, a stepchild, grandchild, or step grandchild — must be unmarried, age 18 or older, have a qualified disability that started before age 22, and meet the definition of disability for adults.

Example: A worker starts collecting Social Security retirement benefits at age 62. He has an unmarried 38-year old son who has had cerebral palsy since birth. The son may start collecting a DAC benefit on his father's Social Security record.

It is not necessary that the DAC ever worked. Benefits are paid based on the parent's earnings record.

  • A DAC must not have substantial earnings. The amount of earnings we consider substantial increases each year. In 2023, this means working and earning more than $1,470 (or $2,460 if you’re blind) a month.
Certain expenses the DAC incurs in order to work may be excluded from these earnings. For more information about work and disability, refer to Working While Disabled: How We Can Help.

What if the child is already receiving SSI or disability benefits on their own record and turns 18?

02-27-2023-2311 - carpal tunnel or carpal canal

In the human body, the carpal tunnel or carpal canal is the passageway on the palmar side of the wrist that connects the forearm to the hand.[1]

The tunnel is bounded by the bones of the wrist and flexor retinaculum from connective tissue. Normally several tendons from the flexor group of forearm muscles and the median nerve pass through it. There are described cases of variable median artery occurrence.

When any of the nine long flexor tendons passing through the narrow carpal canal swell or degenerate, the narrowing of the canal may result in the median nerve becoming entrapped or compressed, a common medical condition known as carpal tunnel syndrome (CTS).[2][3]

02-27-2023-2310 - The superior transverse ligament (transverse or suprascapular ligament[1])

The superior transverse ligament (transverse or suprascapular ligament[1]) converts the suprascapular notch into a foramen or opening.

It is a thin and flat fascicle, narrower at the middle than at the extremities, attached by one end to the base of the coracoid process and by the other to the medial end of the scapular notch.

The suprascapular nerve always runs through the foramen; while the suprascapular vessels cross over the ligament in most of the cases.[2][3]

The suprascapular ligament can become completely or partially ossified. The ligament also been found to split forming doubled space within the suprascapular notch.[4]
